Michigan Criminal Harassment Lawyer Paul J. Tafelski Explains Criminal Harassment

Apr 7, 2022

April 07, 2022 - /PressAdvantage/ - Michigan criminal harassment lawyer Paul J. Tafelski releases a new article (https://www.michigandefenselaw.com/criminal-harassment-lawyer/) explaining criminal harassment in Michigan. The lawyer mentions that in each state, harassment is governed differently. Each state has different laws and jurisdictions regarding harassment. In Michigan, there is no specific law that deals with harassment, however any action that frightens and harasses another or invades the privacy of another person is considered unlawful.

“Most prosecutors pursue these accusations under Michigan’s stalking laws, bringing charges against an accused individual with the potential for serious penalties, possible jail time, and a criminal record,” says the Michigan criminal harassment lawyer.

The lawyer explains that one of the key elements in stalking is unconsented contact. Any contact with the victim that is unwanted or in disregard of their desire to not have any contact is considered unconsented contact. The lawyer adds that a victim can be stalked anywhere. Someone who is accused of stalking is at risk of losing their freedom.

Attorney Paul J. Tafelski also says that another type of stalking is called misdemeanor stalking. This type of stalking is defined as “a willful course of conduct involving repeated or continuing harassment of another individual that would cause a reasonable person to feel terrorized, frightened, intimidated, threatened, harassed, or molested.” Penalties for this type of stalking are more severe if the victim is under the age of 18 or if the stalker is five years older than the victim.

In the article, attorney Tafelski also says that if someone is convicted of stalking, they may face serious penalties including fines and jail time. Misdemeanor stalking may be punishable by one year in jail, $10,000 in fines, or five years in prison plus fines, depending on the circumstances of the stalking. Aggravated stalking may be punishable by up to 10 years in prison and up to $15,000 in fines.

According to the criminal defense attorney, “Stalking has an emotionally-charged aspect that can lead to its abuse. False accusations can be made, particularly when it concerns relationships that end badly. Unfortunately, Michigan stalking laws can be broad and vague.”

Lastly, attorney Paul Tafelski emphasizes that if someone is facing accusations of stalking, it is important to seek the help of an experienced defense lawyer. Having a skilled defense lawyer may be able to help the accused protect their rights and their freedom.
